General information on data processing
Scope of the processing of personal data

The collection and use of personal data of our users generally take place only with the user’s consent. We collect and use personal data of our users only insofar as this is necessary to provide a functional website as well as our content and services. An exception applies in those cases where obtaining prior consent is not possible for factual reasons and the processing of the data is permitted by legal regulations.

Legal basis for the processing of personal data

Where we obtain consent from the data subject for processing operations involving personal data, Art. 6(1)(a) GDPR serves as the legal basis.

For the processing of personal data necessary for the performance of a contract to which the data subject is party, Art. 6(1)(b) GDPR serves as the legal basis. This also applies to processing operations required for carrying out pre-contractual measures.

Where processing of personal data is necessary to comply with a legal obligation to which our company is subject, Art. 6(1)(c) GDPR serves as the legal basis.

In cases where vital interests of the data subject or another natural person require the processing of personal data, Art. 6(1)(d) GDPR serves as the legal basis.

If processing is necessary to safeguard a legitimate interest of our company or a third party, and the interests, fundamental rights, and freedoms of the data subject do not override the aforementioned interest, Art. 6(1)(f) GDPR serves as the legal basis for the processing.

Purpose of data processing

Temporary storage of the IP address by the system is necessary to enable delivery of the website to the user’s computer. For this purpose, the user’s IP address must remain stored for the duration of the session.

Storage in log files ensures the functionality of the website. No analysis of the data for marketing purposes takes place in this context.

These purposes also constitute our legitimate interest in data processing in accordance with Art. 6(1)(f) GDPR.

Data erasure and storage duration

Personal data of the data subject will be deleted or blocked as soon as the purpose of storage no longer applies. Storage may also occur if provided for by European or national legislators in EU regulations, laws, or other provisions to which the controller is subject. Data will also be blocked or deleted when a storage period prescribed by the aforementioned standards expires, unless further storage is necessary for the conclusion or fulfillment of a contract.

Contact form and email contact

Description and scope of data processing

Our website provides a contact form that can be used for electronic communication. When a user chooses this option, the data entered in the input mask is transmitted to us and stored. These data are:

  1. Date and time of the request
  2. First name, last name
  3. Email address and telephone number (if provided)
  4. Message

During the submission process, your consent to the processing of the data is obtained and reference is made to this privacy policy.

Alternatively, you may contact us via the email address provided. In this case, the personal data transmitted with the email will be stored.

Right to erasure / obligation to erase

You may request that the controller delete personal data concerning you without undue delay, and the controller is obliged to delete such data if one of the following reasons applies:

  1. The personal data concerning you is no longer necessary for the purposes for which it was collected or otherwise processed.
  2. You withdraw your consent on which the processing was based according to Art. 6(1)(a) or Art. 9(2)(a) GDPR, and there is no other legal basis for the processing.
  3. You object to the processing (Art. 21(1) GDPR) and there are no overriding legitimate grounds for the processing, or you object to processing pursuant to Art. 21(2) GDPR.
  4. The personal data concerning you has been unlawfully processed.

Right to data portability

You have the right to receive personal data concerning you that you have provided to the controller in a structured, commonly used, and machine-readable format. You also have the right to transmit these data to another controller without hindrance, provided that:

  1. the processing is based on consent pursuant to Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, or on a contract pursuant to Art. 6(1)(b) GDPR, and
  2. the processing is carried out by automated means.

You also have the right to have the personal data transmitted directly from one controller to another, where technically feasible, and provided this does not adversely affect the rights and freedoms of others.

Right to object

You have the right, at any time and for reasons arising from your particular situation, to object to the processing of personal data concerning you pursuant to Art. 6(1)(e) or (f) GDPR, including profiling based on these provisions.

The controller will no longer process the personal data unless compelling legitimate grounds for the processing can be demonstrated that override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims.

Right to withdraw consent

Purposes of data processing by the controller and third parties

We process your personal data only for the purposes stated in this privacy policy. Transfer of your personal data to third parties for purposes other than those listed will not take place. We only forward your data to third parties if:

  • you have given your explicit consent,
  • the processing is necessary for the performance of a contract with you,
  • the processing is required to fulfill a legal obligation,

the processing is necessary to protect legitimate interests and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data.

Collection of general information when visiting our website

When you access our website, information of a general nature is automatically collected via a cookie. This information (server log files) may include the browser type, operating system used, the domain name of your internet service provider, and similar data. This information does not allow any conclusions to be drawn about your identity.

These data are technically necessary to correctly deliver the website content you request and are mandatory when using the internet. They are processed in particular for the following purposes:

  • Ensuring a smooth connection to the website
  • Ensuring smooth use of our website
  • Evaluation of system security and stability
  • Administrative purposes

The processing of your personal data is based on our legitimate interest arising from the aforementioned purposes. We do not use your data to identify you personally. Recipients of the data are only the controller and, if applicable, processors.

Anonymous information of this kind may be statistically evaluated by us to optimize our internet presence and underlying technology.

Cookies

Like many other websites, we also use “cookies.” Cookies are small text files stored on your hard drive by a website server. Through this, we automatically receive certain data such as IP address, browser used, operating system, and internet connection.

Cookies cannot be used to start programs or deliver viruses to a computer. Based on the information contained in cookies, we can facilitate navigation and ensure correct display of our webpages.

Under no circumstances will the data collected by us be passed on to third parties or linked to personal data without your consent.

Of course, you can view our website without cookies. Internet browsers are usually set to accept cookies. In general, you can disable the use of cookies at any time via your browser settings. Please use your browser’s help functions to learn how to change these settings. Please note that some functions of our website may not work properly if you disable cookies.

SSL encryption

To protect the security of your data during transmission, we use state-of-the-art encryption methods (e.g., SSL) via HTTPS.

Server log files

The provider of the website automatically collects and stores information in so-called server log files that your browser automatically transmits to us. These include:

  • Browser type and version
  • Name of the accessed webpage
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer/provider
  • Date and time of the server request
  • IP address

No merging of these data with other data sources takes place.

The legal basis for data processing is Art. 6(1)(f) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures.

Applications

By submitting an email application, you expressly consent to Günther GmbH Temperaturmesstechnik collecting, processing, and using the data you transmit for the purpose of handling your application. You also accept our data protection regulations. Your personal application data will generally be deleted after the application process is completed, as soon as they are no longer necessary to fulfill the purpose of storage, or at the latest after 6 months.

Use of Google analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses “cookies,” text files stored on your computer that enable analysis of your website usage. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

Because IP anonymization is activated on this website, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

On behalf of the website operator, Google will use this information to evaluate your use of the website, compile reports on website activity, and provide other services related to website and internet usage. The IP address transmitted by your browser within Google Analytics will not be merged with other Google data.

The purposes of data processing are statistical analysis of website use and compilation of reports on website activities. Based on website usage, further related services may then be provided. Processing is based on the legitimate interest of the website operator.

You may refuse the use of cookies by selecting the appropriate settings on your browser; however, please note that you may not be able to use all features of this website in full.

You can also prevent Google from collecting and processing the data generated by the cookie (including your IP address) relating to your use of the website by downloading and installing the browser plug-in available at the following link: Browser add-on to disable Google Analytics.

As an alternative, you may disable tracking on our website by clicking an opt-out link that sets an opt-out cookie. This prevents future data collection by Google Analytics for this website and this browser as long as the cookie remains installed.

Use of Google maps

This website uses Google Maps API to visually display geographic information. When using Google Maps, Google collects, processes, and uses data about the use of the map functions by visitors to the website.

For more information about Google’s data processing, please see Google’s privacy notices. There you can also modify your personal privacy settings in the privacy center.

Detailed instructions on how to manage your own data in connection with Google products can be found there.

Embedded YouTube videos

Some of our webpages include embedded YouTube videos. The operator of the corresponding plugins is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit a page with a YouTube plugin, a connection to YouTube servers is established. YouTube is informed about which pages you visit. If you are logged into your YouTube account, YouTube can associate your browsing behavior with your personal profile. You can prevent this by logging out of your YouTube account beforehand.

When a YouTube video is started, the provider uses cookies that collect information about user behavior.

Anyone who has disabled cookies for the Google Ad program will not receive such cookies when viewing YouTube videos. YouTube also stores non-personal usage information in other cookies. If you want to prevent this, you must block cookies in your browser.

Further information about data protection at YouTube can be found in the provider’s privacy policy.

Plugins and tools

MyFonts

This site uses MyFonts. These are fonts that are loaded into your browser when you visit our website to ensure a consistent appearance. The provider is Monotype Imaging Holdings Inc., 600 Unicorn Park Drive, Woburn, Massachusetts 01801, USA.

To verify license compliance and monthly page views, MyFonts transmits your IP address along with the URL of our website and our contract data to its servers in the USA. According to Monotype, your IP address is anonymized immediately after transmission so that no personal reference can be made.

For details, please refer to Monotype’s privacy policy.

Changes to our privacy police

We reserve the right to adjust this privacy policy so that it always complies with current legal requirements or to reflect changes in our services, e.g., when introducing new services. The new privacy policy will apply on your next visit.

Objection to advertising emails

We hereby object to the use of contact data published as part of our legal notice obligations for the purpose of sending unsolicited advertising and information materials. The operators of the website expressly reserve the right to take legal action in the event of unsolicited advertising, such as spam emails.
